Why this policy exists
Mobile networks, regulators and the public trust business messaging only when it is wanted and honest. This policy applies to everyone who sends SMS, WhatsApp, Telegram, voice, USSD, email or any other message through Beep Africa, including sub-users and reseller clients.
By using our services you agree to follow it. It forms part of our Terms of use.
Consent comes first
- Only message people who have given you clear permission, or who have an existing customer relationship with you and would reasonably expect to hear from you.
- Keep a record of when and how each person agreed, and give it to us if we ask.
- Direct marketing needs consent under Kenya’s Data Protection Act 2019. Never use bought, rented or scraped contact lists.
- WhatsApp messages must also follow Meta’s WhatsApp Business and Commerce policies, including opt-in and approved templates.
Opt-outs
- Every promotional message must tell people how to stop receiving messages, for example “Reply STOP to opt out” or the operator’s opt-out short code.
- Honour opt-outs promptly and do not message that person again for marketing unless they opt back in.
- Our platform supports suppression lists; you are responsible for using them.
Timing and frequency
- Send promotional messages only between 8:00 am and 8:00 pm East Africa Time, unless the recipient has asked otherwise or the message is urgent and transactional.
- Don’t send more messages than people would reasonably expect.
Prohibited content
You must not use Beep Africa to send, promote or link to:
- Fraud, phishing, scams, fake prizes or messages pretending to be another organisation
- Illegal goods or services, or content that breaks Kenyan law or the law where the recipient lives
- Unlicensed gambling, betting or lotteries, or unlicensed lending and financial services
- Adult or sexually explicit content, or hate speech, harassment or threats
- Political messages that don’t follow election laws and IEBC and Communications Authority guidelines
- Malware, or links designed to hide where they lead
- Misleading health claims, or content that endangers public safety
Sender identity
Messages must clearly identify who they are from. Use only sender IDs registered to you and approved for your use. See our Sender ID & Content Policy.
Using the platform responsibly
- Keep your login details and API keys secret, and use sub-user permissions and IP restrictions where you can.
- Don’t try to get around our limits, security controls or filtering.
- Don’t resell our services unless you have a reseller agreement with us.
What we do if this policy is broken
We monitor traffic and act on complaints from recipients, mobile operators and regulators. Depending on how serious the issue is, we may block messages, suspend sender IDs, sub-users or accounts, or end your service. Credits used on blocked traffic are not refunded. We may report illegal activity to the authorities and share information as the law requires.
